This started happening in the summer. Every time, we all were told it was the LAST time this would ever happen, oh, we are so sorry, ect. and they would refund us the bounce check fees our banks charged.
This week was the last straw as there wasn't ANY money to meet payroll.
While I am certainly looking for another job, I am wondering if I and my co-workers have any legal recourse with these clowns? Most of us are now in trouble with our banks for these bounced paychecks as they are now causing our own checks to bounce.

ETA: By all means, taking our checks to the company's bank IS what most of us have been doing as of late. A couple still had some faith in the owner and deposited them and now they are in trouble.
However, this week, when I went to the company's bank, there wasn't any money at all. Our manager tried to blow this off claiming that I was lying until he tried in his turn and had the same results.
I assure you, I am looking for another job!

The company is bankrupt! Get out fast!

File a formal complaint with the State employment department, wage and hour vision. It is against the law not to meet your payroll on the specified day, and yes, bouncing the checks IS a violation. It may take a while to collect, so Good Luck on that job search. In the mean time, why are you wasting your time working for someone when you won't be paid? Spend that time making job applications online and off. You might want to relocate if lots of others in your area are employed by the same employer, because it's obvious they are going down!

Yes you do, First I would find a new job and then file a complaint with the State you are living in. You might not have much recourse if they pay your bounced check fee's and the payroll. But it sure will make the state look at them.

Take your paycheck to the bank it is written on and cash it. If it can't be cashed because the funds aren't there, then you wont be writing bad checks on your account. I only had it happen to me once. After that (as long as I worked at that place), I made sure the paycheck was good before I started spending it. As for whether or not you have legal recourse, I don't have any idea. I hope someone else can help you with that. Good Luck!

Well, if the paychecks bounce, what confidence do you have that a check to settle a lawsuit would not bounce.

While you should take them to court, don't count on seeing any money out of it.

yeah and get a judgment that is worthless and impossible to collect. just quit and file a complaint with the state. they will eventually get your money for you.
