I found a piece of plastic in some ice cream & contacted the co. instead of a lawyer. I only wanted to tell them so that they could protect others.

Do I think you're stupid for not wanting to make a quick buck in a massive lawsuit? No. Do I think you're smart for contacting the manufacturer? Yes. The manufacturer will be able to make changes and issue recalls, if necessary, faster if the tip comes from a consumer instead of lawyer. Good job.

No, it's not stupid to resist the urge to try to suck a company dry over a simple mistake. Keeping other customers safe by informing the company is an obvious first step. There could be other pints of ice cream out there that could be recalled before others find, or eat, plastic. So no, you're not stupid.

And if the company isn't stupid, they should give you some free ice cream for being a stand-up citizen.

You are not stupid...you had an instinct to maybe call an attorney but your hunch was that the lawsuit was meritless and you decided to call the company instead to complain.

Your hunch was right. The lawsuit is meritless b/c you have no reasonable damages. You did not suffer any physical injury and seeing a piece of plastic in your ice cream is not outrageously shocking enough to create mental or psychiatric problems or injuries. However,if it had been a human finger you saw in the ice cream or a dead mouse, those types of cases seem to be actionable as seeing the item in your partially earten food product is shockingly outrageous.

You did the right thing.
someone could have been chocked or killed by it. The company's health and safety needs to be checked over. They do not seem to be customer friendly or doing a great job.
If they were the ice cream would be just ice cream without added plastic to kill.

The legal system is not a lottery. Sometimes accidents and mistakes happen. You could have sued if your child choked to death, but the only government agency you could really go to is the FDA if no one was hurt.
If you were not hurt why would you deserve money.
You did the right thing

BTW: if you want to get paid, you can still call the networks and talk shows, just make sure you can summon tears of anguish for the camera about the threat to society.
That is good journalism, I sure one of the major talk shows or news shows might pick it up.

Bless you! Not everything has to be settled with a lawsuit! I don't think you are stupid at all, in fact, I believe you are a very level headed woman. By the way, I have worked for a court system for twenty plus years and have seen really dumb lawsuits in my time. Good for you, dear!

No. I can't stand people that just want to sue everyone to get easy money. Nothing good comes from ill gotten gain. It probably was a part of the mixer that broke and accidents will happen. Most companies will offer you at least a replacement.

Actually the same thing happened to me. The company sent me
a check for 50 dollars. No lawyer involved.

The only thing stupid was thinking of calling a lawyer who would have told you " Why are you calling me"

It didn't hurt you. It couldn't have hurt you beyond maybe chipping a tooth, and I doubt you'd bite that hard into ice cream.

If you had sued you'd get precious little and your lawyer would get 1/3 of that.

If you'd found a razor blade in there....
