i wrote : and it happened in thier front yard, the 2 guys were trying to grab him cause they knocked him off his bike with thier truck and he was crawling back wards on the ground, so his sister ran inside and got thier mom, and when she came out the guys took off, my nephew is ok, but the cops came 2 hours later, and my sister in law said she was gonna shhot them. the cops told her if she did she wouldbe in jail. i really dont understand why, if it was on her property and shes trying to protect her child, shed be sittin in jail, they told her, if your gonna shoot, shoot to kill, theres 2 sides to every story. the system here is so messed up.

SORRY I FORGOT TO ASK THE QUESTION: I dont understand why she would be in jail if she was protecting her kids, especially if it was on her property. id shoot the guys who tryed to mess with my kids.

Depends upon where she lives. There is some variation among the states. And yes the DA would have to decide to press charges, after she was arrested. And yes the best advice, if you do have to shoot, on your property, shoot to kill. As morbid as it sounds, no one to sue you or press charges.

You can shoot someone as long as you are in fear for your life. And you are right the cops will tell you shoot to kill. Most mothers will do anything to protect their kids!!!
They would have to arrest her because she did shoot someone.The police would have to prove what happened.

The only time you can harm another person is if you, yourself, were in physical danger and it was self defense. You cannot even help someone else out who is being attacked by striking their attacker, as that could be assault on your part.

The mother has no right to shoot someone. Period. She would be in jail because that is illegal.

The police can't tell her what would happen, only what they'd do. If they arrested her it would be up to the DA whether or not to file charges and whether or not to got to trial.

well, you're not allowed to shoot someone. even if they're messing with your kid. an eye for an eye leaves everyone blind.
