I dont hvae time to care for an animal of any kind.I know the intentions are good but the gift is BAD.!!!

You decline to accept...you can give any excuse you want, allergies, landlord, no time, no desire....but make sure the person knows that this is VERY inappropriate....these sorts of gifts often end up abandoned out on country roads where they starve to death or are killed and eaten by coyotes...I've seen years of city animals dropped off out in the country and it was a mercy to shoot them. The idiots assume some farmer will take them in...not true, one can only afford to feed so many animals.

Find the animal a good and loving home, then tell the person that gave it to you that you appreciate the gesture, but you don't have the time to give a pet the time and care it needs. They should understand!

give the animal back and explain in all fairness to the pet you can not accept as you have neither the time or knowledge to look after it, as well you do not even know how to find a new home for it, and they may be able to get a refund
