Talk to a Lawyer he should be able to have it taken off your record. It will always show up when they do a background check but if is esponged they can not use it against you!

In order to get that off your record you are going to have to hire an attorney, they will fill out the proper paper work and take it before a district court judge, he then will look at your record, and if nothing else is showing, can at his own discrection have your record esponged. Its not a real hard process, but the attorney gets his money for taking this before a judge. Once the record is esponged, then it is removed from all court records, to never be found again. And make sure you always hang on to the espongement.

hat do you mean you gave the money back and that was the end of it? Was the case dismissed or the charges dropped against you? Were you acquitted? If yes, then you shouldn't have anything on your record. I would go to the clerk of the court in your jurisdiction and get to the bottom of this.

Strike_ea couldn't be more wrong. Just about every single first offense misdemeanor is expungeable after 2 years, provided you aren't convicted of the same offense again and you satisfactorily satisfy the terms of your sentence.

I think Strike_ea is confusing a "Pardon" with Expungement. I think only the President or the Governor can Pardon convicted prisoners serving jailtime.

Why wasn't the handwriting on the check looked into. It should be taken to a handwriting analyst and checked against other things she has written. If its in the lady's handwriting, that should clear up everything. If this pans out it shouldn't have to be esponged, it won't show up at all because it never happened.

Hey I am a veteran too. Go see a lawyer, they usually don't charge for the first visit. I had somethin exspunged off my record. It cost five hundred dollars and the lawyer goes through the court system and then goes throught the FBI computer database and your states database to make sure its off that as well so when people do background checks it won't show up.

It depends on the state you live in. I practice in MI and there is a very rigid test you must meet to get something expunged. A criminal defense atty in your home town should be able to ask the right questions to give you an answer.

And, if you happen to live in MI, email me at asnyder@sbcglobal.net for a free consultation! =)

IN AMERICA UNLESS THE CRIME WAS COMMITTED AS A MINOR OR THE JUDGE SET LIMITS AT SENTENCING YOU CANNOT HAVE ANY CONVICTION EXPUNGED OFF YOUR RECORD. THE ONLY PERSON THAT CAN EXPUNGE YOUR RECORD IS THE GOVERNOR OR THE PRESIDENT.
EVEN IF YOU'RE FOUND TO BE NOT GUILTY THE ARREST WILL ALWAYS SHOW UP.
