I have not heard of a case where someone was breaking and entering or robbing a house and was successful in suing the owners of the house for hurting himself in the process of committing a crime. However, I see by others posting links that it probably has happened.
I understand that if you have a vicious dog in your yard and someone hops the fence with the "intent" to rob your house, if there are no signs indicating "No Trespassing" or "Guard Dog Present", I believe they may be justified (in some states) to sue you because they did NOT actually commit the crime, and they were not warned not to come on your property.
By the way, there was also a case in the news recently where a burglar broke in and stole a camera from a man's house. On it, he found several pictures of porn involving minors, including the man's own daughter. The burglar proceeded to phone the cops and advised them where they can pick up the camera, and the police promptly went and arrested the man (who had been burglarized) for various charges involving the corruption of a minor. That is one case where the burglar actually had a certain level of scruples and chose to do the "right" thing.

Don't have a link to it, but I know there was a case (I think in Florida) where a burglar was locked in someones garage for 7-8 days while they were on vacation and he sued and won for mental anguish, etc.
Of course, thanks to Mitch Needelman, we can now shoot intruders and there will be FAR less burglars winning civil suits.

there sure was about two years ago. a man tried to break in a couples house in california while they were on vacation. he went in throught the garage the door went down ,he got locked in the garage and didnt have anything to eat for four days but a dog biscuit. any way he finally got out he took them to court ,claimed he almost starved to death and actually won the case .this is true i saw this on the computer.

Sadly, in these days of litigiousness and people's total loss of common sense, there are tons. Thankfully, though, while the burglar may win his lawsuit, he still goes to jail for his crime. A small consolation.
