Unethical business practices that aren't illegal can't be prosecuted in the court of law. However, that doesn't prevent *litigating* unethical behavior, which has its own steep costs.

But if practices are unethical, there's the possibility of low employee morale (a productivity killer), employee turnover (and the costs associated), and possibily the of loss of customers (see Bank of America, http://boingboing.net/2006/11/15/bank_of_america_lose.html).

Ethical consequences? I didn't know that there was such a thing. But if I think I understand your question I would say that maintaining your integrity and reputation are the conseqences for being ethical.
