husband was married in 06 not 05. Now that they are living together under the same address. He wants file for HofH w/ dependents and she wants to file head of households with dependents too. Is this possiable.Can you use the same address to file head of house hold. But they wasn't married in 05 and moved in together in august of 05. Married 2/14/06 she say HELP ASAP

If they lived together under the same roof at any time during the last six months of 2006 then they have two choices only for filing. Married, filing joint; or, Married, filing seperate. Under Married, filing seperate they forfeit earned income credit. Go to IRS.GOV and read the instructions for correct filing status if you need further details. 36 years of tax prep experience speaking here.

Only one of you can file head of household using the same address...The one who makes the least amount of money should file head of house hold with the dependents because that is who will come out with the most money.....

You can file married, married but seperately and this will forfeit your tax credit for head of houshold....

If they are claiming different dependent(s) (not each other) they may get away with it. But if they are married why not claim married? It would probably be better. Do they have children or other dependent persons living with them? They should go to a CPA or one of the Tax services - they will see how they will get the biggest legal refund.

Yes as long as they did not live together for at least 6 months and 1 day in 2005, they both can claim head of household.

i.e. 1/1/05-7/1/05 apart Yes claim HH.

To claim HH you must be apart for at least 6 months (so basically 6 months 1 day)

Ask a tax preparer, but I doubt it. Only 1 person can file as HOH, as far as I know.

They live together and are still married, doubt it.
