If you do get fired for working for free then that is a dumb azz company you working for.

You can be fired, day or night, on or off the clock, over the phone, text, facebook, face-to-face or even a plane carrying a banner. The law doesn't state how or when an employer must fire someone. That is solely left up to the employer. While you're free to sue, you won't win. If she doesn't have the authority to fire you, then you can speak to the supervisor that does and see if you are actually fired or not. What you did WAS insubordination regardless of whether you were on or off the clock. Even if you are on your break you are still representing McDonalds. It's not their fault you didn't read the handbook and know it's against policy to have your cell phone out. When they asked for you to put it away, you ignored them. If you ARE fired, it is entirely legal and you would have no recourse. Nothing they did went against the law.

Yes you can.

The reason is that when you work off the clock you subject the company to possible legal action from the government and fines. If you don't take your breaks and lunch, even if you chose not to, the company could be fined for it. The law does not say that the company has to give you those breaks and lunch unless you choose to forgo it. You by law are not given a choice in the matter. The reason is that companies then would expect you to forgo your breaks and lunch.

I worked for Home Depot for three months and they tell you during orientation that you will be terminated for working off the clock. I love that concept.

If you think about it that is a good policy. I have worked for many companies that expected me to do volunteer work. That is, work off the clock.

Once the employer requires you to volunteer, regardless of the cause, it is your time and they are requiring you to work. This is illegal and amounts to indentured servitude and slavery.

So some companies like home depot just make it plain and simple that you will be terminated if you are caught working off the clock.

Yes, because by law, worker's compensation coverage does not cover you when working off the clock--a company that takes this law seriously may terminate you for this offense. If you are hurt while working off the clock under these circumstances, then the company and not their insurer would be responsible for paying your medical expenses and lost wages, etc. In other words, the worker's compensation insurance company may find that they are not liable to cover those expenses because it did not happen while you were being paid for the work.

If it is your company's policy of not working off the clock. You may be fired. If not, I can't see why you would be fired for working, especially if they have you doing it. Seems like this would be something they wouldn't want to do.

The answer is yes and the reasons are OSHA and Workman's Comp. insurance. You are actually a liability rather than an asset to a company when you work off-the-clock.

yes definitely. you could become injured and worker's compensation will not pay for it because you were off the clock the company will have to pay rather than their insurance paying it is a liability for the company.

however, if your state is a "right to work" state -aka- an "at will" state, you can be fired for any reason at any time.

If you are in an "at-will" state, you can be fired for any and no reason at all.

This is especially the case if there is something stated in the employee handbook about this. However, like I said, you can be fired for any reason. They have to cover their backs.
