When the judge sentenced my friend, she stated that he would get credit for time off of his house arrest for time that was spent in county jail. However, the time is not credited, and there is nothing in the sentencing record. A lawyer told us it would cost $500 to file a form to get this fixed. Since it's their fault for not following their own instructions, why should we have to pay? Is there something else we can do to get this fixed without spending hundreds of dollars?

You can file the form yourself...... You will have to do some research and make some phone calls to the court, but you're paying the lawyer the $500.00 not the court....unfortuantely the lawyer didn't make the mistake....the court did, so you can either pay the lawyer to take care of the paperwork....or do it yourself....

sounds like the lawyer wants to make money. what i'd do is go to the law libary and get the form on this matter and bye a copy of the minutes of the sentencing . and go home and fill it all out and you will have to pay for it to be on the next court date and you can take care of it your self... i'd study it very careful and go over it for a few weeks befor court. you can do it in louisiana, so good luck

Get a transcript of the court proceedings and if you do need to pay to file you should also have the lawyer request that the state pays you back........

you should ask for a transcript of the court proceedings, to get proof that the judge actually said this. it may cost a couple bucks to get this, though.
