and how do i prove who is responsible for maintaining the fence, as in dispute with neighbour about whose responsibility it is to maintain and repair

Contact the nearest office of the Land Registery who will send you a copy of your deeds if you dont have them. The builder's rule is that if you go to the end of your back garden and look back at the house you are responsible for the boundary on your right. But that isn't always born out by the deeds. When I got mine for a 19th century house I owned it left it very unclear who was responsible for any of the fences that got blown away in a storm so i ended up not being able to get either neighbour to pitch in for the cost!

common law accepts that a fence on the property line belongs to both parties, regardless of who installed it, and both are responsible for repair. If the fence is on one property or the other, then that person is responsible for maintenance. But, if his failure to maintain his property is causing you grief, then you have the responsibility to resolve your problem (put up your own fence). Or if you are getting benefit from the fence, then be the good neighbor and repair it yourself (and take before and after pictures)

As a rule of thumb - if you stand facing the house as if you were ringing the door bell, the boundary to 'your' right has to be maintained by the neighbour and the one to your left is your responsibility.

check your deeds check thiers then if this fails to solve it contact the land registry office but it should be included in either set of deeds when you or your neighbour purchased your houses.it might not be in writing but thier should be a diagram of the two plots adjacent to each other and you shouldd be able to tell from there, if you still have probs then get yourself down to one of these solicitors tht do 1/2 hour free legal advice it shouldnt take any longer than tht for them to sought it out by looking at the deeds.

As others have said, your fence or walls should be clearly marked on a plan attached to the deeds of your house.

Your local council planning office should have details of this on record . If not , they should be able to point you in the right direction and to the right department .
