I was in a car accident on 11/21. I was injured and taking percocet, flexeril and naproxen inhibiting my abilities to drive and work. I was under doctor's excuses from 11/21 - 12/2. My boss elected to take my vacation away in December to make up for the days missed that were not excused by doctors (3 total, not 5).
I ended up getting fired on the 4th after requesting a family medical leave. I was a dedicated employee and planned on staying at my job until I was at least finsihed with college.
What I don't understand is how an employer can fire someone from being injured in a car accident an unable to come to work due to pain and discomfort along with being on narcotics to releive the pain!
Help!

There is nothing that can be done, even excused on doctor's notes? This just doesn't sound right at all to me.

Not to mention they were excused! My doctor's KEPT me out of work! How can I work at a job while on narcotics? Isn't that illegal anyway????

As far as girls being known to be slackers, I am a divorced single mother of two going to college part-time and working full-time and paying for everything without anyone's help. I am the last person to call a slacker!

You are entitled to FMLA if your employee by a company with 75 or more employees in a 50 mile radius, meaning 2 business within 50 miles of each other. Also you would have had to work for 1 year fo them. If this is the case, call wage and hour to file a complaint.

Sorry about your situation, but employment without an employment contract, is usually at will which means that you can quit at any time or you can be fired at any time, for any reason or no reason at all, without notice. Now, if they are in violation of the Family Medical Leave Act, you might have a claim, but I don't have enough facts to evaluate that. Employers cannot terminate your contract for no good reason.
You could have a case for unfair dimissal. It wasn't even a long time you had off, just a couple of weeks!

Sorry, buddy, most states have 'at will' laws for employers.
They don't need a reason to get rid of you, and there's nothing you can do about it, unless there was some sort of gender, racial or sexual orientation discrimination.
So, unless you're black, female or gay, you're shi t out of luck.

You should talk to a lawyer, but an employer has the right to terminate any employee, sucks don't it.

do they have a terminate at will policy? it's not fair but if they have a terminate at will policy they can let you go for any reason.
