i have a question, i have been seeing my doctor since july, when i knew i miscarried, but since then i have not felt good and it hurt to walk on my left side. I kept going back into the dr's and they kept doing blood work and kept telling me i was pregnant and prob going to miscarry this happened for several months, my numbers would go up a few then down then up.all the dr;s kept telling me was that i was a puzzle. The dr finally after me saying this was enough sent me to a gyn, he did surgery on wed and found a dead fetus in my fallopian tubes that he said had been there for at least three months, and that my tubes were swollen.Isnt this negligence on my dr's part by not seeing what the problem was. I have contacted a lawyer just wanted to see what all of you thought thanks

I have heard of this case before and they same that it is not to rare. And I think that he should have done something alot sooner to get you the help you need. I would definitely call your lawyer and see what he has to say on it. Good Luck!

Well, first and foremost be aware that you will have to PROVE negligence on the part of the doctor you are suing.
Simply because he didn't find anything initiallydoesn't me he was negligent in any way. He ran tests, found nothing of concern, but finally sent you to an obgyn. Those sound like normal procedures to me.
You have to remember also, that the type of lawyer you are using is in the business of doing almost nothing but suing people. They will take almost any case a person presents/asks about whether it truly has merit or a basis for a realistic law suit.
Also be aware, that usually these lawyers take from 33% to 40% of any settlement you get. Additionally, you have to pay for any and all costs that are associated with preparing the suit, or for court appearences of any "experts" he may use. If he uses another law firm to help him with the case, they will usually charge between $200 and $300 an hour. You will be billed for any and all phone calls, emails, or the like that you initiate. You also get billed for any letters or memo's you are sent.
I hope you get the picture. Just because a lawyer says he will take the case doesn't mean much and you have to remember is nothing but a "cash cow" for him/her.
If you do decide to go ahead with a law suit, put it in writing with the lawyer that you want approval of any and all experts, investigators, etc. that he/she may want to hire. It's the only way you can control how much the lawyer spends. Normally, you will have to sign a financial agreement with the lawyer so make your inputs to that agreement also. Don't sign any already prepared forms he/she may have until you get what you want written into the document.
Just wanted you to be aware of the "hidden costs" etc.

he should have definitly done an ultrasound or an xray or something if you were complaining that much and the fact that he thought you had a couple miscarriages in just a few months he should have sent you to a gyn a long time before he did! you poor thing that is just awful. and you could have been seriously hurt, i would definitly contact a lawyer. i hope things work out for you. good luck to you. oh and i really hope he didnt screw things up for you and you are still able to have children later when you are ready again. i would be so angry i dont even know how you are dealing with this. again so sorry to hear about that and good luck.

When do you think that the brain starts to function? Just before or just after birth? WRONG- the brain starts to develop, which means there is life, just a few weeks after conception- you can look this up on the web- it is scientifically proven. Just because a brain is not fully developed does not mean that it is dead. Your theory does not hold water my friend. A baby that is just born does not have a fully developed brain either. Actually a brain is not fully developed until a person reaches sometimes into their 20's. A brain that is developing is "life".

I think that they should have done an ultrasound to make sure everything passed and and ultrasound of your tubes were ok. Best of luck to you and I am sorry for your lost. Fight for what you believe to be wrong because it could have caused you your life.

omg, thats awful. I would have flipped out. It sounds to me that it would be the dr.'s fault, if you were hurting that bad he could have had you checked earlier. Sorry that happened to you.
