I bought a G.I. Joe figurine from somebody through ebay. I received my "package" yesterday. The seller had simply put the figurine in a small envelope with a bit of bubble-wrap to protect it. There was no sellotape holding the envelope shut, so the contents subsequently forced open the seal.

So... What I actually received was an envelope with a bit of bubble-wrap and an accessory of the figurine (but no figurine!!).

I contacted the seller and they said they could not offer a refund unless I returned the item. But I never received anything!

Any ideas on how to resolve this matter? I believe the seller is responsible as it was poorly packaged... What do you think?

I paid £5.50 and originally the seller offered a £2 refund which leaves me having paid £3.50 for nothing. The seller denies the fact that it was poorly packaged and claims sellotape was used on the envelope...

I'll supply you with a £3.50 refund (the cost of the item). Unfortunately we are both out of pocket here and I'd like to reassure you that tape was placed across the envelope. I have sent several of these out in the last week and all have arrived well and intact (even to France and Poland!), it would appear that the Royal Mail was against us.

I apologise for your disappointment with the non-receival of the item, however these things do happen occasionally and the best way to resolve them is to negotiate to a solution. I trust that my proposal for an item refund is satisfactory to you.

I will send a cheque in the post.

You need to open a dispute with eBay now. You only have a limited time to do this, and even though the seller has promised to mail you a refund, he may be just stringing you along.

Simply tell the seller, you should not be out any money, shipping or otherwise, and if they will not do a full refund, let them know you are contacting eBay and reporting, and then if the seller will not comply contact ebay and report it. I buy and sell on ebay and stuff does happen, but that's part of it, and the seller should know, things happen and sometimes you have to be responsible for items you ship. With all the mail deliveries right now, it may well NOT be the sellers fault, but the postal service, but its still up to the seller to make it right. Good Luck.

If you paid through PayPal, they may refund you.

PayPal are notorious for acting as judge / jury, despite what evidence is available.

I know this because I sent a wallet from Thailand WITH NO POSTAL INSURANCE INCLUDED, and the person did not receive it, and despite my pointing PayPal to the postal website showing it had been sent, they 'found' for the other party. And despite 100% positive feedback, and despite no postal insurance, they stole the money from my account.

So you may be ok, if, you used PayPal.

Personally, it does sound like the other party was negligent in packaging the item. So send 'nothing' back, and you would have fulfilled your 'obligations'.

Report this to eBay. There is a place for complaints. The sellers are allowed a shipping rebate, so whatever you paid for shipping, usually most of it goes to the shipper. Give the seller a bad rating, and say why the rating is bad. But do take it up with eBay. They can't stop stuff like this unless people tell them about it.

Hi,

I recently bought something from eBay that I wasn't happy with. I opened a dispute though Paypal, and they refunded me. You should not be out of pocket. I sell on eBay also, and would never offer a partial refund for something that was my fault.

If you didn't pay via Paypal, you can report it through eBay also.

I hope you get your money back!

i would contact ebay. state you have contacted the seller and they refuse to refund. or contact the seller again stating you will contact ebay if the situation is not resolved and you will leave negative feedback.. that usually gets them to do something.! good luck!

Unless you paid extra for insurance then your unlikely to get any money back. Best you can do is leave negative feedback and report it to ebay.

report it to ebay and ask them what you should do, alternately if you paid via paypal you can have a full refund and leave it at that.
