If the person recording the conversation is part of the coversation it is not illegal. If the person talking to you give the person who is recording permission to record the conversation then it is also not illegal. But if the coversation is recorded by a third party without anyone present's consent, then is it is illegal as long it is not in a public place. Hope this makes sense?

Depends on where you're located. In the United States, the law varies from state to state. In Ohio, a conversation can be taped with the consent of only one person in the conversation. The others don't even have to know, never mind consent.

It depends on what state you live in. In some states both parties have to be aware that the conversation is being recorded. Here in Indiana it is legal to tape the conversation without the other party knowing.

It is illegal to do so under English law, with the exception of having the express written permission of the Home Secretary. However, interestingly, if a conversation is accidentally recorded, like when you phone someone and they take so long to answer their answer machine picks up and starts recording and then they answer, and their was no deliberate intention to record without permission, a judge will allow that as evidence in legal proceedings

No one can tape a conversation you are having with them without your express permission. Similarly, no third party can tape a conversation without the permision of the people involved. These conversation are not permissable in any type of court. However, should someone tape a converstion without permission with the intent to use it for their personal use... there is nothing you can do about it
