I suppose it depends on how much the court-ordered support is, and how much his wife makes. Things like sports fees are extra, but toys and clothes are NOT. My boyfriend has to pay $550 a month of child support, and $300 a month for "special expenses", which is what child care costs are considered in Ontario. So, his ex-wife gets $850 a month for one 2 1/2 year old, and she makes over $70,000. If, according to Canadian law, the parents financially support the child equally, then a 2 year old costs $1700 a month. I don't buy that at all, but that's the law. I don't mind that he has to pay, but I am glad his ex has the good sense not to ask for money for clothes and toys when she's already getting a ton of support. I do wish, however, that there was some sort of accounting for how support money is spent. I doubt that every custodial parent spends it how they are supposed to...

Nope.
The only way he can get out of paying child support is if he gets a formal decree from the court, and even that is temporary in nature. Most courts will hold that if you are reasonably able to hold a job, you should be paying child support. It sounds like she's getting jobbed. File a complaint and see what happens. The judge is going to take a look at this "psychiatrist's care" very closely.

Yes your dad still has to pay child support. The only way he does not have to pay child support is if he is dead or you turn 18, and some states will make him pay if you are in college and you go right out of high school. Your mother needs to get in touch with her local child support enforcement office. Any custodian of a minor child who needs help collecting current or past-due child support payments are eligible for child support enforcement services. These services are there for the child so they can get the support that is needed, so the burden is not on just one parent. If you mother don't know where to go tell her that any local department of human service can get her in contact with the right people so your support can start again. Good Luck and I hope this has helped you and everything goes well for you and your mother.

No, if he's getting a "crazy" check; you should be too. Check with your nearest social security office and find out if he's drawing disability; if so, the government will make sure you'll get your "cut" right from his check... I'm assuming your Mom has a petition from the court to receive support payments, if not, that should be the first step... Even without a job, in the state of Missouri, they still have to pay a minimum amount, mine was $143 and the deadbeat, still didn't pay that!!!
Best Wishes; my son's father owes $16,000, I just received a notice from Child support office today, stating they have located the deadbeat out-of-state and will plan to pursue the matter from there. Hang in There!

unless he is in a mental institution and doesnt work then he still has to pay child support. Even if there was some truth to what he says he would have had to go through the court system and get the child support order modified so your mom would know about it. Your mom has a child support order right? tell her to contact a child support enforcement agency (it costs like 25 bucks) and they will go after him

I would say that as long as he is capable of having a job, then he should still have to pay, but if he's been certified by his doctor as not able to work, then, I think he might be able to get out of it. If it goes too long term that way, though, he might have to file for disability benefits and in that case, your child support would come out of it FIRST, as per the government, before he saw any of it.

No she need to go to the state attorney general office and they will attach his taxes when he gets money back and also his SS number so whenever he works she will get paid. They just take it That's how they do it now . If he refuses he can be jailed.
I worked in mental health many people tried that ploy it did not work. Your mom just has to press the issue.
Good luck
