Is Murder Act 1965 allow Death penalty or not? if not, what is the name of the constitution or law that allow Death penalty

In England, the Murder Act of 1965 put a moratorium on the death penalty for 5 years, and substituted life sentences. In 1969 Parliament voted to abolish it permanently. Part of membership in the EU requires that countries abolish the death penalty, but a moratorium has been deemed acceptable.

In the US, there are only a few crimes that the federal government may execute people for. Article 3 allows Congress to decide the penalty for treason, and last I heard, the death penalty could be used as punishment for that. However, states have their own laws; some are in state constitutions, like MI (no death penalty since 1846), or are in statutes.

First...there is only one constitution! I don't believe the death penalty is commented on in the US Constitution.

As far as I know the death penalty is determined by state laws. Capital punishment is only sanctioned in 38 of the 50 states (as well as by the federal government and the military). So each state would have its own law about capital punishment.

The 14th amendment says it's not unconstituational.

"nor shall any State deprive any person of life, liberty, or property, without due process of law"

Since it's not unconstitutional, the federal government can have laws that either allow or forbid it.
