I am a installer and i also go back and move the things i install for people.i get paid .35 percent of our install labor charges. i am starting my own business and i want to begin telling the customers in a few mths there will be a cheaper option. ( the company i install for is the only one in northern california) We can do it for cheaper and i make more money. Is it illegal to give word of mouth advertising.

It is not "ILLEGAL" meaning you risk jail. Nor is it unethical since as the population grows the market expands and you would simply be serving a growing market.

Don't let the business ethics sissies tell you otherwise.

The only way you can be sued is if when you stated working for your boss he made you sign a contract with a non-competition clause.

Which states that you agree not to do business in his field for a number of years within a certain geographic location (your city or county) after you leave his firm or anytime during your employment.

If you did not sign anything like that or any contract saying that you promise to keep his business operations secret.........you're good to go buddy!!!!!!!!!!!

Check local laws. But in general, if you solicit business while employed and especially while on the clock, your employer has legal recourse. As long as you haven't signed a non compete agreement, your best, and most ethical option is to start your own business, and then go after your customers.

Illegal - no. Unethical - yes. And if "word of mouth" gets back to your current boss, you may lose your job before you're ready to be without a paycheck.

It is illegal. If you boss has a good attoreny than he can win.

Its simple as an employee you are an agent of your boss. It is an agents duty to act on the best interest of the boss not his/her own. If he/she does than its breach of trust (breach of fiduciary duty)

Your boss will have a valid reason to come after you and win.

In fact it may be illegal depending on your state laws. You may also be liable for any money your employer loses. You are technically under a contract with your employer and have a financial reponsibility to him.
