You cant throw a man out of his own house so if his name is on the lease you better go.You should also know that he can keep everything in the house and you cant do anything about it so I suggest you pack up and file for divorce now!

Well I think you should realize you are both grown adults here, stop beating around the bush. Tell him you are filling for a divorce and then HE can decide himself whether or not to come back. Unless there is a threat of physical violence, then be a big girl and tell him how you feel. I am sure he will appreciate you being honest rather than being a sneaky woman. You said you have kids with him and he WILL be in your life on one level or another until you die, might as well keep it as peacefully as you can. Good Luck, do the right thing.

Depends on how ruthless you are. Filing while he is out of town will put you at a strategic advantage. In most states, you can't just file for divorce, put his stuff out on the curb, and lock him out of the house. Nor can you take off with his kids. You have to file, and then get a temporary custody order, which is easier to do if he's not around to defend himself. Not very "nice," but . . .
On the flip side, if you file when he's out of town, it will probably make things very, very difficult between you. He'll feel like you stabbed him in the back, and the divorce will turn even nastier.
Spend the money and call a lawyer - even if it's just for an initial consultation.

Fill while he is out of town. IF you have a safe place to go, take your children and go there. It will be hard getting back on your own two feet for awhile, but you can do it! And when he come's home from an out of town, he'll get the papers and come home to an empty house! He'll get the idea then! And if he's accussing you of cheating everytime, maybe he's the one who is really doing it and it's bugging the hell out of him! The one to do is the one to accusse. I would say if you hate the guy file for divorce while he's gone, otherwise talk to him first and tell him you want a divorce. But hey, I'm not even married, so what do I know.

Well, if he's sending home money for the rent, I guess I'd stay, and put his things in a storage.
Once you have filed, inform him you've filed.
I've been accused of cheating, because they were! It was their guilt.
NOW all I do is accuse of any boyfriend. BUT it was bread into me for years.
Don't forget to take him for enough to care for the kids.
