A real legal conundrum. No adoption by gay couples in VA. If Cheney says "nevermore", partner Poe has no parental rights. Rationale: it's better to have one gay parent than two.

Actually, yes they CAN get married in a few states. Generally speaking Mary Cheney would get custody as she is the natural mother. However, her partner, if she can prove Ms. Cheney to be unfit, could indeed obtain custody. What normally happens is that the other partner adopts the child, assuming 1/2 of the parental rights. Mary Cheney would sign 1/2 of her parental rights to her girlfriend.

But you bring up a good point. We need to change the law so they can get married to protect the child. They can of course if they move to Mass., or emigrate to Canada, Belgium, Spain, the Netherlands, or South Africa. They will soon be able to marry in Columbia too.
