Well a friend of mine filled contempt of court on her exhusband for non payment of bills (credit card) $3,000, non payment of splitting doctor bills and non payment of retirement savings account under the divorce decree. He was suppose to pay all this off a year ago has not paid a dime. He just recently got out of jail for contempt of child support which he served 1/2 yr in jail. What can the judge do to get him to own up the divorce decree? Will the judge just put him in jail again (which I am thinking he likes it there) most importantly he wont pay, can the judge seize property such as his car or house to help pay? I am at a lost for her because I feel if he goes to jail it wont help pay the bills he owes. If it helps in is the in the state of TN.

So the state of TN can do work release program? Sadly she cannot afford attorney and I wrote up the orders for the contempt for her. I got the court cost waived for her since she is below poverty level. Do you know where I can print of lein form?

The court can order him back to jail and on work release until the debt is paid or just continue to put him back in jail. Her attorney should request the judge put him on work release until he catches up within a reasonable amount. And yes, they can attach wages and seize property for contempt of court. Her attorney should petition the judge to issue a lien on his home if he owns it since its a valid debt which he has not paid.

Fortunately, the laws here in TN are pretty routine. There's not a lot of wiggle room. Unfortunately, it really depends on your legal counsel and your judge as to what remedies are used.

Your friend could see about having her ex-husbands wages garnished at least for the child support payments. I don't know about seisure orders but I think the guy deserves it. Unfortunately there are guys out there who'd rather sit in a jail cell than pay child support.
