It depends on the state. In a "Right To Work" state they can fire you at anytime without giving you a reason .

I know that my employer could...As an employee, I am considered a representative of the company, and they have made it clear that they will not accept illegal activity either at work, or during my off hours.

I suppose it would depend on whether or not this has impacted your ability to work. If you are required to have a license to drive, and this DWI may revoke your license, then the employer may well be within his rights to fire you.

It depends..... There should be a written policy governing what happens if an employee gets a DWI.....
