Xanax is a controlled substance. It is a pharmaceutical and it's possession without a prescription is a minor felony in all 50 states. Marijuana is a controlled substance and is a misdemeanor if possessed in small quantities. You don't say which side of the debate your taking, but if you're pro felony, use the legalities. If you are against, the use of these two drugs are minor violations in the scheme of things and should only be a misdemeanor. By the way, if both drugs were in small amounts, say less than one oz. of weed and just a couple of pills, most likely a plea bargain would be reached in which the person would be charged with a misdemeanor as long as they completed probation and a drug class.
