Yes, but in general teachers are not always well-educated, and for some reason I meet silly teachers rather than good-educated and more than i want to and have troubles with them when testing. so why the right to take the decision is given to such an inadequate persons

Generally speaking, most teachers are well-educated and are specifically trained on how to assess student learning. Your question is akin to asking what makes a doctor thinks he knows how to make you healthier or how a plumber thinks he can fix your pipes.

Unfair how? What subject are you talking about. Most teachers that I know use a rubric when grading subjective things, such as essays. The grading system for those subjects is set out beforehand so that students can understand what they need to do to get a certain grade. If you aren't getting good grades, then you aren't meeting the criteria.

Anything that is graded subjectively needs to be spelled out ahead of time. I agree with the previous answer, rubrics solve that problem. It will state exactly what is expected and what the grade will be at each level of accomplishment. If you are talking about something that is concrete (math problem, multiple choice, etc.) then I don't see how it would be subjective.
