It really depends on the enforcement level of the state the child support goes through. Generally speaking, if he does go to jail it probably won't be for long. Miraculously, sometimes when a guy (or woman) goes to jail for nonpayment they suddenly have the ability to get caught up.
Some people will think you're vindictive, but I think anyone who does something to hurt a child should be punished. Nonpayment is harmful to a child's quality of life.

It depends.
Most of the time contempt is a last resort for the toughest cases. The judge is probably going to look at his record. If he has not been jailed before, the judge could order that he pay a certain amount in time or he goes to jail, or the judge could order that he seek a reasonable employment and if he does, then suspend the case.
As far as the minimum goes, again, it probably has to do more with the state that you live in. Probably around the range of 6 months.
As far as being happy, yeah, it's human to have a little shadenfreude when you've been screwed, but don't let him become the center of your life. Chances are, if you describe him accurately, this is just going to be a revolving door of small payments jailtime moving.

doe depend on the state. In Ohio they let them off on first offense and give them 90 to start paying, then second offense is 30 days in jail then 60 then 90 however it takes so long to get a court date and actually get in there that if they even make a minimal payment of even $10.00 a month they will take that as effort and not do anything! I'm waiting on $17,000 in arrearages and have had my daughter adopted to stop the future. She'll be a senior beofre he pay it off at this rate. Good Luck.

the only way he will go to jail is if the judge decides your ex havent been respond to court orders of child support what you need to do is find a way to probe he is working at the bar and getting pay for it and that is hard and if he is only holding a partime job well it goes according to what he makes usually is 17% of gross income sometimes the best thing to do is take the visitation rights away that will hurt him eventually

no, he's not going to go to jail, so stop being so vindictive and trying to ruin this man's life, just because he never loved you and doesn't want to be with you. Sounds like he is TRYING to work, and have a life....but he still has to eat and live to. Just because you are jealous gives you no right to put him in jail. He's done nothing wrong, but give you the time of day one night, and you obviously wanted it then, so get over yourself, and get a job.

I was there a long time ago. My ex didn't pay his for long time. they took his drivers license first. then finally he got a job and they started to garnish his wages. He didn't like going to court knowing he is going to go to jail if he didn't pay. That is what the judge told him this last time he was in court.

It just depends on the state and county. I currently am owed $28,000. and still no jail time. But usually the first jail ofense is only 30 days.

Where I live, over $1000 is a felony. Unless he can pay the entire amount when he goes to court, he should get one to three years.

he might if he's not showing up to court he will...i'm going though the same thing....my daughter's father isn't paying so i called it in and they said if he's two or more months behind he could do time....i hate that men can be deadbeats and its up to the mother do everything and the child(ren) suffer..wish the tables were turned and women could leave, had no responibilty.
