I bought a G.I. Joe figurine from somebody through ebay. I received my "package" yesterday. The seller had simply put the figurine in a small envelope with a bit of bubble-wrap to protect it. There was no sellotape holding the envelope shut, so the contents subsequently forced open the seal.

So... What I actually received was an envelope with a bit of bubble-wrap and an accessory of the figurine (but no figurine!!).

I contacted the seller and they said they could not offer a refund unless I returned the item. But I never received anything!

Any ideas on how to resolve this matter? I believe the seller is responsible as it was poorly packaged... What do you think?

I paid £5.50 and originally the seller offered a £2 refund which leaves me having paid £3.50 for nothing. The seller denies the fact that it was poorly packaged and claims sellotape was used on the envelope... This is his most recent offer

I'll supply you with a £3.50 refund (the cost of the item). Unfortunately we are both out of pocket here and I'd like to reassure you that tape was placed across the envelope. I have sent several of these out in the last week and all have arrived well and intact (even to France and Poland!), it would appear that the Royal Mail was against us.

I apologise for your disappointment with the non-receival of the item, however these things do happen occasionally and the best way to resolve them is to negotiate to a solution. I trust that my proposal for an item refund is satisfactory to you.

I will send a cheque in the post.

Yeah same as the rest.
Contact Paypal.
I bought an xbox last year and paid about £180 and never recieved a thing. I filed a claim with Paypal and had most of the money back within 2 weeks. They are easy to deal with and they do this kinda stuff every day. At the end of the day, you paid for something, you didnt recieve the item as described, therefore he/she has broken the contract entitling you to a full refund.

If the seller is uncooperative, then you will need to first file an "item not received" from the drop down box in Ebay next to the item. Then it directs you to PayPal if you paid via PayPal. You can open a dispute then in PayPal (I am hoping you paid via PayPal, because if you did not you will have a hard time getting your money back). When you open a dispute it gives the seller the opportunity to resolve it then. If not, escalate it to a claim. Be sure to keep all packaging so that you may show it to PayPal in the event they ask for it. You have 45 days to escalate a claim. If you do not, the claim will be closed automatically. A seller's responsibile to get you the items that you order. If they do not make it all the way into your hands, they are responsible for the replacement or refund. It could have been just faulty packaging. Check their feedback as well & make sure they don't have a habit of sending "empty" envelopes. Good Luck.

you are actually (theoretically) protected by e-bay itself, if you haven't received the item you have every right to claim a refund.
However, nothing is guaranteed, so do the following (and pray):
First tell the seller that you're not satisfied at all with his business, and that you want your money back, even if that means that you have to send back what's left from you purchase. If seller still doesn't care, tell him that negative feedback will be left for him and that e-bay will be notified. If again nothing happens, then contact e-bay.

It really might not be the sellers fault. Ever seen how the post office treats the mail?? It's awful. I think if the seller made a reasonable attempt at packaging (and trust me I have gotten far worse packaging then what you described when buying from Ebay) then you should let it go.
I think that there is a place on Ebay to report Item Not Recieved. I'm not sure if this is covered though.

Some Royal Mail staff do tamper with the parcels.

You could start a dispute through Paypal if you paid with this method.

However, go to the Post Office and ask for a claim form. Fill it out and send off the packaging. This way you should receive compensation.

I agree.
Take a photo of the item as it arrived, explain the situation again, give them every chance to do the right thing.
If no go - open a dispute with the seller. You can also leave negative feedback but be warned they will do the same!
You may not be able to retrieve your money or replacement but you can stop them from doing the same to someone else!

If you bought insurance on it, you're all set. If not, you need to file a grievance with eBay and PayPal (if that's how you paid), but be forewarned: I have never gotten my money back when I have lodged a complaint with them. Also, remember to leave negative feedback so others know what to expect when buying from that seller.

If you paid via PayPal just log on to PayPal and file a dispute with the seller and you should have your money back with 14 days.

They are definately responsible. The best thing to do is to raise a complaint through paypal. Maybe you should even tell the seller that youre going to do so first - they might just give in.

you should pursue this horrible little b*st**d to the ends of the world.....and go through the ebay procedures of course. And...don't forget to give him some nasty feedback (to stop anyone else dealing with him). What was his feedback rating like anyway? I won't deal with anyone that has a negative rating. You can cost him more than what the figurine was worth and you should tell him that.
