Yes you can sue. And you should.
Get an attorney that deals in personal injury. They specialize in these type of cases.
Then go to your dentist, and have him asses the damage to your tooth (or teeth), and put it in writing.
Have the attorney sue for the cost of reparing your tooth (teeth), plus the extreme emotional distress of finding someone's earring in your food!

You could sue - but for what? Since you incured no loss, and you can't even see the chip on the tooth, the suit would be deemed meritless.
Write to the company's head office, explain what happened, and ask them to provide 'reasonable compensation'. They'll probably send you a few bucks and some free restaurant passes.
You should also report it to your local public health dept as a good citizen.
This is not a hot cup of coffee case - you are not getting rich off this.

One of the problems with this country is a bunch of sue conscious pansies want something for nothing. You should have took the burrito. Ask yourself if you want people losing there jobs or going out of business because they made a mistake?

File in small claims court.. depending on where you live you'll be capped at a certain amount. Anywhere from $2000 to $5000. You can sue for your medical bills and possibly pain and suffering.... but I wouldnt go overboard on this. Make sure you keep documentation of everything. Call the place you got it from ASAP and complain. See if you can make a report with their insurance company and avoid the suing altogether. If they are willing to just settle with you - for your medical bills and maybe some damages.. usually they are willing to do that. I would look into trying to settle out of court, before pushing for a lawsuit immediately.
However, first - get to a dentist to get checked out.. and save your bills.
if your insurance company pays for your bill, if you do collect a settlement, you'd have to pay them back first before you pocket any money. If you don't thats called Insurance Fraud.
