State agency has authority to charge criminally, or go for civil penalties. Executed a search warrant and then decided to file a civil complaint and want to use the docs as evidence in the civil case. Seems like an end-around civil discovery. Can they do this?

Any document seized through a valid search warrant can be used in any legal proceeding.

When they ask you how do you plea, you should plea "no contest" so that way I don't believe that they would be able to use the evidence against you in the civil trial.
