It would be easiest to say that neither would win, but that wouldn't really be fair to the guy you are referencing. Regardless of who that guy is, you would be guilty of intentionally aggravating the situation with physical violence; assuming you mean a physical "fight." It is implied that this is what you are contemplating, since you are wondering "who would win." In a nutshell, even if you won the physical confrontation that you are contemplating, you lose in the end, because you used the wrong tactics to resolve the issue, whatever it is. The only exception to that conclusion is if you are physically attacked by the "guy."
