I am in my 7th month of pregnancy, I am due in February. My fiance got arrested a few days ago and it is looking like he will be locked up for awhile. My question is what is the procedure for having him sign the birth certificate and proof or paternity since we are not married?

Just to address some of the incorrect information that’s been given here--an unmarried woman cannot just ‘list’ someone’s name on a birth certificate as the father…in ANY state. In order for his name to be listed on the birth certificate paternity will have to be established. He can voluntarily establish paternity (without involving the courts) by signing a declaration of paternity/affidavit of paternity/whatever it’s called in your state. But it’s not going to be as simple as just getting the form and taking to him to sign. Why? Because of the possibility of forgery. At the very least, it would have to be notarized (obviously with him providing proof of his identify to the notary, so they can verify that he is who he says he is). And your state may require something beyond merely having it notarized.

Call the hospital or the department of vital records for your state and ask them how to handle it.

In maximum states, the husband/boyfriend/youngster's father isn't required to signal the beginning certificate. They ask you for the training and then the wellbeing archives branch prepares the beginning certificate.

Ask the hospital where you are having the baby what the procedure is for filling out the form for the birth certificate.

I have had kids in three cities in three states and my husband was never asked to sign anything. It was all up to me.

I think all that is just put on hold till he is released.Only you will be asked to sign the birth certificate and the paternity testing will just have to wait. You should still be able to get the document redone after he gets out if you want him to sign the birth certificate.

I Know I have heard of women putting mens names on the Birth Certificate maybe you can sign yourself, ask your Doctor.

Call the hospital, and ask for Birth/Death certificate registration and ask them the proceedures- good luck

uh you dont cause you dont want your child remembering someone in jail as their father, but if you really do I am almost positive you must go through the courts first.

go during visiting time and ask him to sign it, or send it to him to sign
