My 6 y/o has always lived with me and now his father has came back in town and his friends have told me that he's trying to get custody and to be careful and watch out for him. he does pay child support but neither of us have legal documents of custody.. to be on the safe side I told his father he could visit him all he wants but hes not taking him out of my view. Is this right or wrong of me .. what could he do... im working on getting a lawyer and papers.. thanks

You can stop the father from seeing his child or him taking the child out of your vision.

No that's not wrong. I've been through this. The best thing to do is not keep him from seeing your child. That will look very bad in court. Another thing would be making sure that he doesn't find no faults with you. Some farthers like to nitpick and find the little things to say child neglect. Stay on top of everything.Get it in writing. Everything!!!! Why did he wait all this time? That's the number 1 question. Getting a lawyer was the best thing to do. Legal advice is always the best thing to do. I hope this is helpful. Keep a positive head and no matter what know that you're a good mom no matter what anyone says.{ hint: They will use this sometimes, but don't argue.}

I came across this when my daughter was younger..My ex (her father) had cld the cops on me because of the fact that I wouldn't let him see her because he had showed up...2 hours late and not in anycondition i would want her to see him in. Well the police officer at the scene basically told me that since we didn't have papers. If he was to have her and run out of state that I couldn't do anything. Because of the fact that there wasn't a custody arrangement. So no I think that you are completely in the right there. And when all the paper work is set into place. Then you can work on the every other weekend thing..until then visiting for a few hours with you there..its a perfectly understandable idea.

The sooner the better with filinig papers, I live in California and was told by the court clerk that in a custody suit the person that files first will get custody until the end of the hearing. Always get everything in writing. I have kept a journal of all phone and personal conversations and visits ect. Good Luck!!

until you see a court summons you have nothing to worry about. a mother automatically has custody in most states. if the father goes for full custody he would have to prove you unfit or have a damn good lawyer. in most cases either established visitation would be granted (either supervised or non supervised) or partial custody would be granted (6 months out of the year)
My advice to you is if the father wants to be involved in the childs life do not deny it. I am going through a similar matter myself but on the other side of the fence. I am the father.

You guys need to get documents like me i am a custodial parent and he is the noncostdial and he gets her everyother weekend and every wendesday and hes suppose to pay child support and never did for about 8years and now hes on it!!!!! But he cannot not take her when it is not hes weekend unless i say so and if he does that is kidnapping. So i would go to your attorney general and get it done before its to late

go get a parenting plan to protect yourself. otherwise he has just as much legal right ot take him as you do
