What? Who the hell has custody now?

It depends on the situation. You would want to file for custody only if the other parent was unfit. If they aren't don't pull your daughter thru such an ugly battle. If they are unfit, you will have to contact a good attorney, preferably one the same sex as the parent you are fighting against and they will help you prove them unfit. Good luck!!!

The same way you would if you had been married. You go to whatever court has jurisdiction of divorce and custody! Marriage is not a requirement!

YOU GO TO FAMILY COURT AND YOU FILL OUT A PETTITION FOR CUSTODY.
YOU GET ALL THE PAPER WORK GIVEN TO YOU BY THE COURT.
YOU SERVE THE MOTHER OF THE CHILD WITH THE ORDER TO REPORT TO COURT FOR CUSTODY HEARINGS.
THEN YOU GET READY FOR THE MOTHERS BARRAGE OF INSULTS AND SHE WILL PROBABLY COUNTER WITH CHILD SUPPORT ORDER.
YOU THEN GET AN ATTORNEY AND GO TO COURT.
