I bid on an Nintendo wii 3 days after it was released on 19 NOV. When I received the Wii (which I paid over $400 for) I noticed the extra game the seler included was open. I then inspected the Wii. It had also been used, then placed back in the box.

I contacted the seller. He states he never said it was new. well he never said it was used either. After several emails back and forth and the seller refusing to give me a refund, I have contacted customer support but they have not responded. That was 4 days ago. Average response time is suppose to be 24-48 hours.

what other steps can I take?

So if a pair of NIKE sneakers just came out on Friday and I sell them on Saturday, if a buyer buys them it is their fault for not asking me if I wore them. Im off the hook because i never said they were new, shouldnt i have stated they are used then? Same case with a $150 over retail priced Wii

The item has to be sold as described. If it was not, then you have a case and you should open a call with PayPal, this is the best and most efficient way of complaining using eBay.

If the seller did not state it was new and everything you got is as he described (whether he left out information or not), then he has done nothing wrong and I can't see you winning this case. you must read every word when buying from eBay and you must always pay with PayPal for the larger items, it's for everyones benefit.

if you paid using a credit card via paypal, you can contact your credit card company and dispute the charge. Speak to them to see if they will issue a chargeback. If the credit card company says they will, you will have to return it with some kind of proof of delivery and then they will reverse the charge leaving Paypal with the loss.

Paypal in turn will go after the seller to recover the loss.

The only thing you can say is that the product was not delivered in the condition it was advertised and that you feel like you are being ripped off.

Good luck and be careful in the future, eBay auctions specifically state weather the item is new or used. If it doesn't say new you must assume it is not.

By the way, if you paid with a bank transfer, you are screwed.

So let me get this straight...

You bid for the item, you paid for the item, you received the item, and it works.

Now you want a refund but you still have the item? How is that fair?

Did you receive the warranty information with the Wii? If so, then where's the problem.

well hopefully this will teach you to use places like ebay to by systems, of course they get played, regardless of them sayin it is or not, and i dont think customer support can do anythin for you anyway, should of just waited for it in store
