When writing a play using fairy tale characters (i.e. like the Shrek movies) after what period do you have to wait to legally use them with out infringing upon copy write laws.

Most fairy tale characters are in the public domain (i.e. 3 blind mice, the muffin man, puss in boots, snow white, prince charming...) . You cannot use images of characters that appear in current illustrations, comics, movies, or videos. The

Copy write laws protect the work for the life of the author plus 70 years. After this time it goes into open domain which means anyone can use it without worry.

If the characters are more than 78 years old, they are in the public domain and can be used without permission. The characters in Shrek which are unique to that movie are not in the public domain.

Most of the answers are correct, but it should be noted that the copyright holder (whether it's the creator or not) can renew the copyright, lengthening the time before it enters the public domain.
Traditional fairy-tale characters are seldom covered by copyright, though.
