The only time I think it is justified is when it is court ordered as in capital punishment..or in self defense .....as for animals... only for food or your life do I think it is justified. :o(

No statute of limitations on murder. Once tried for a murder, a suspect cannot be tried again due to Double Jeopardy.
Is it ever justified to kill a person or animal? If animal is protected by endangerment laws, than any killing of it would be a criminal act. Vegans would consider all killing of any animal to be a criminal act...

I can't think of anything that could justify the killing of another human being. Unless their on death row for killing more than two people in a violent painful manner. Then he deserves it. Dogs are different. If their rabid, or continually attacking people. Or if their too old to walk anymore without being in so much pain. That's why my dog was put down, it was a mercy kill. Saddam Hussein deserves to die because of his role in the genocide.

You'll want to check out the Model Penal Code, specifically the Defenses. Defenses have two classes: Justifications and Excuses.
A Justified Defense is self-defense - to prevent the harm to yourself.
An Excuse Defense is intoxication - to suggest you were so drunk you didn't know you just ran over your daughter
I would suggest wikipedia for sources, as they might have references to lead to more information
http://en.wikipedia.org/wiki/Self-defense_(theory)
Also research Involuntary Manslaughter (I killed someone, it wasn't justified, but I didn't intend it)
http://en.wikipedia.org/wiki/Manslaughter
I have no idea bout animals. That is more of a tort than a crime, as animals are considered 'property' of others. However, it is quite illegal to murder a police-dog (K9 or canine) as they are considered "officers" and murdering a K9 is the same as murdering a police officer, in most courts.

They are usually called self-defense laws. You should be able to find quite a bit with an internet search. There is also something called a crime of passion where in some states a homicide can be justified.

I am not expert, but I will try to answer your question based on what I know. If someone were to break into your house, you have the legal right to shoot and kill that person as long as their in your house. The moment they leave your house, you cannot shoot or kill that person because its no longer self defense.

Maybe you should try the library. I doubt Yahoo Answers is a source suitable for citation in most projects.
