Provided that both cocks sign a waiver of legal rights, I see no reason why it cannot continue. Until such a time as the cocks are the ones making the decision about the fight, it should remain illegal.

By all means it should be illegal, due to the fact that one almost always ends up dead.. The other aspect of that is the fact that more often than not, there are blades attached to their feet and makes it even more barbaric to say the least. If it were straight up just bird on bird, if it were natural in the wild, yes, but they should not be forced to fight...
