Is the Supreme Court still the “least dangerous” branch of government, as Madison claimed?

The president of the Untied States appoints the Supreme Court Justices and the Congress Approves them.

Justices sit for life, unless they do something illegal.

They are least danagerous because they do not have to be swayed by what is in fasion politically, because they have their JOB FOR LIFE. They do not have to work to get relected. They do not have to fear making an unpopular decision.

The Supreme Court is checked by the executive branch (appointments) and the legislative (appointment confirmation and the ability to override with an amendment). The Supreme Court seems to have less power than the other two branches, but can make big waves with just one ruling (Brown v. Board, for example: the executive had to carry out the orders in some areas of the South and Congress had to pass new laws).

If the supreme court overturns a law as being unconstitutional, the legislative branch has the ability to either revise the law or amending the constitution. The legislative branch, on the other hand when they are originally crafting legislation must make sure that it passes constitutional muster.

Yes.

The Supreme Court can not create laws - they interpret what is already on the books. Their interpretation is what everyone looks at and to for guidance. But the Supreme Court can't sit down and write a law. So I think that interpretation is the safest route, considering the dangerous ones go and try to "create" the perfect laws to stop everyone.

Shotgun, or maybe the other branches could write better laws that create justice. Considering the fact that justice is dead.

I think their oly check is by the Senate before they're confirmed.

Justices can be impeached by the Senate.
