You'd be best to ask a divorce lawyer on this but, I say if the house title is in your name only, & your husband is not named at all in the title then the advantage goes to you. However, if he can prove that the house is still a marital asset, & that he contributed to the equity of the house, then there might be some consideration given to him by the courts.

Search "Divorce Virginia" they have the info there or a link to it. Generally anything that was purchased during the marriage is considered half the other parties.

If the house is titled in your name only it should go to you in the settlement, unless you are in a community property state. Then who knows what a judge will decide.

your question is not very clear. i think the house may get sold and you will have to build dreams elsewhere.
