I have been liveing in my current apartment for 6 months now and from the first week I have lived there one of my neighbors have been making continual unvailadated complaints, my land lord calls and e-mails me to stop doing this or not to do that but, he NEVER checks the vadility of her complaints, this has been an on going issue and I have spoke to my landlord a few times and told him these things are not true and he needs to check before he yells, but she keeps doing it and he keeps giving me static do I have anylegal tenant rights that I am covered under or do I just need to grin and bear it?

Yes, send a certfied letter to your landlord listing the invalid complaints. Mention that you consider his constant requests to you as harrassment, and illegal since you are entitled to quiet enjoyment of the property. Tell him if he doesn't stop harrassing you about unsubstantiated violations, you will sue him for damages.

That should get him off your back!

That's a very tough call. If she is only making the complaints to the landlord and he does not do anything about it, then I guess your going to just have to bear it. If she is making these complaints to everyone in the apartment complex then you possible could file a report with the local District Attorney office. If you could get the landlord and the other person together, maybe you could all talk and try to figure out whats going on. Good luck.

stop whatever it is you are doing to provoke the neighbor.

or confront them about it.. see what happens.. if the nieghbor has a legit excuse that seems to have some sense to you.. try to keep that in mind.. and stop it.

if it doesn't...

time to get annoying back... report them.. OH call the cops on them.. think that you heard screaming? or put up s h i t loads of xmas lights around your place... OH run the blender... stomp around.. slam doors....

the landlord/manager has to do this.. it's not their fault... if they even find the time to confirm anything that you may or may not be doing is ... improbable. it's not personal.

if it doesn't stop and you've tried to find out and tried to stop... and it keeps on... time to complain harrassment.. talk to the manager... ask them what your rights are... and talk to someone at city hall. just say you've done what you could.. really and you've tried to make contact with the neighbor but you really can't see what it is that is making the problem.

you do have rights... especially if you aren't doing anything or you have found out what it is and you've tried to stop and still nothing works.

remember.. it is a lease.. you got to obide to the rules.. so does this neighbor.

if you get a 20/30 then it's time for a lawyer if all has been tried said and done.

OR.. if you can... move to someplace else...

maximize your alternatives.

You are kinda screwed on this one. Most states don't have any laws against unfounded complaints. You could start doing the same thing to her. Your best bet would be to start calling the cops on her saying she is threatening you, because she is in a way threatening you. Then take those police reports to your landlord and he will have to take action against her. If you can get a restraining order against her, she will have to move out.

Three options;
1) Talk to your neighbor. Maybe you are unaware of some things that you are doing.
2) Fight fire with fire. Start making ridiculous complaints every day until either your neighbor or landlord gets tired of the game.
3) Ignore it.

GET A LAWYER!!!! Some lawyers will give a basic consultation over the phone, others require you to come in and pay a fee. Some areas of the country have some type of legal aid, where you can go and get advice on your situation for free (or reduced cost).

If your story is true, send the landlord a letter stating that you are being denied the peace and quiet of your residence and that is grounds for braeking the lease. No landlord likes a vacant apartment.

thats a really good question. basically its your word against you neighbors. do you have any other neighbors. if you do go talk to them and ask them if they consider you a nuisence. get them to talk to your landlord. the more people on your side, the less valid your neighbors complaint becomes
