I have been sick for awhile&had a CT SCAN & they said that a large metal staple had been left in me after gall-bladder surgery& that this might be causing some of the pain i have! do doctor's leave metal staples in you after this type of surgery and if not do i have a mal-practice case or is it too late because i just found out about the staple being left inside me yesterday,but my gall-bladder surgery was about 5 years ago.I have been in pain all this time and have been diagnosed withjust about everthing and nothing has worked. please only serious answers only

This is definitely the type of case that should be reviewed by an attorney. There are many issues involved, but without a complete review of the case no real judgment should be rendered. My suggestion is to call the local bar association and ask for 2-3 referrals for competent attorneys that deal with medical malpractice. You should talk to each one before making a decision about how to proceed.

As an aside, most operating procedures include a scrub nurse who is responsible to count everything before and after to insure nothing is left in the patient. A staple... not sure about this.

Have you thought that maybe the staple was left in on purpose? These are medical devices used to close off things like, the tube from your gallbladder to the bile duct, AKA cystic duct. When they remove the gallbladder, they need to shut off the flow of bile from the liver into the cystic duct. This clip is made of silver, or titanum, and will show up on a CT scan. But does not cause all the other symptoms you mention. Any wonders why lawyers feed off this type of hysteria? Why don't you just ask the surgeon who did the surgery, or have your family doctor read the operative report of the surgery, it should mention if any clips were used.

I believe the statuteof limitations is 7 years. Staples should not be left inside you because the metal can corrode and can cause an adverse reaction.I would consult a good malpractice lawyer

i think it's mal-practice, go to your doctor and explain what happened, they have to remove it for free, as it was the surgeons fault and not yours.

also get a lawyer for compensation and medical bills you got as a result of this.
