Legally, if he paid for it, it is his. He gave you the ring as a conditional gift. The condition was that you were to get married to him. Since you're not getting married, he gets the ring back. It doesn't matter who broke off the engagement. If you don't return it, he could take you to small claims court to make you pay him the money he paid for it.
Why would you want it anyway? You'll get another one from the man you love when you get engaged in your next relationship. Why keep something as a constant reminder of a failed relationship.

If you break it off, you give back the ring
If he breaks it off, you can technically keep the ring.
You can techically keep the ring either way, there isn't a law saying you can't. However a ring is a gift in contemplation of getting married. If you don't get married, you broke the conditions that the ring was given and it should go back. Some judges will see it like that, but others won't really enforce it.

Yes, the ring is given with the assumption that you will marry. If the marriage is called off, for any reason, the ring must be returned.

Legally, I believe yes - the ring is given as a token of a promise - if the promise is broken the ring needs to be returned.

In my beliefs....something like this would mean you need to give the ring back....otherwise you will "hold" this guy in your mind and heart forever...the ring was a symbol of a "bond", and since there is no bond now, why would you want the ring?

You are to give it back because you are promising to marry him, it is like a contract, it is yours until you get married, once you get married, you get to keep the rings because you married him...But a engagement ring is only saying that you agree to marry this person on a date that you both agree to....Unless you both agree that you can keep it, then you must give it back....

holding the ring would show resentment and selfishness. He spent a lot of money, so why should he not be allowed to get some money back and start his life over. That is the human thing to do.

Now if you try to give the ring back and he says he doesn't want it. Then it is yours with a free conscious.
