can an officer of the law make up a false piece of document,and use it agianst you?

Please be more specific. First of all, do you mean a police officer or an attorney?

Without knowing anything else, i would say no. Making up or forging documents to obtain a conviction would be "malicious Prosecution" and is actionable by you.

Yes, they can and do it all of the time!

Is it legal, NO! It will cost an officer his/her career if caught participating in the submition of false or misleading information.

Will any officer or agency do anything to stop or correct the problem, NO! infact they'll bust their balls to enforce the malfeasance.

Take for example a recent client of mine, he was charged with possession of a controlled substance. Truthfully, he did have cannabis stems and seeds in his ashtray. Nevertheless, these items are not illegal to possess and they are commonly used in legal US products (exp. premium bird seed, some beers, and oil extracts the stems are used to make hemp, paper, plastics,ect.) Check the controlled substance schedules for yourself.

The officer arrested him for it anyways as a malicious vendetta because he had accidentally stumbled upon him(officer) illegally breaking into cars and searching them. Anyways, to over come this "technicality" he and a fellow officer filed false and misleading Affidavits by the courts instruction. Their statements were basically as follows:

Found and confiscated ashtray contents; one zip lock bag weighing 44 grams, cannabis.

This makes it sound like he had and ounce and a half (a serious charge), when in actuality the majority of the weight was pennies and cigarette butts, and though they had the physical evidence in their possession the court refused to allow it to be presented at court (for obvious reason) This also, if true should have been turned over to BCI (bureau of criminal investigation) for analysis and verification but suspiciously it was not.

As a result i was able to get the prosecutor not only removed from the case, but terminated in disgrace for persuing the charges on the evidence, as well as the officers in trouble. Legally, this should have been an end to the matter as the state forced them to drop the charge. But in their anger the court decided to recharge him(client) with Drug Abuse and Trafficing. This cocky move cost the new prosecutor his job and the judge her bench(courtroom) but not her position, she was demoted to traffic court. I truly enjoyed watching her cry as she was getting arrested by the state police. But don't think the state police will protect you, they were extremly pissed and allowed her and other members of her court to threaten and intimidate the defendant into accepting a plea bargin to stop her arrest which failed.

You'd think they would have given it up but, a year and so later the defendant was re-arrested at work on the same charges for the same incident only to create an embarassment and financial difficulty for him($50,000 bond). Creating a double-jepoardy situation which they and the state just ignored was occuring. They weren't going to allow a jury tial as we demanded, they couldn't and we had them in a trap. This didn't stop these worse than criminal types suffering megalomainiac pshycoses(officers)though .

Unfortunately, or maybe not, the client became weary of the blatant corruption and exemptions made for these officers especially when he had never surrendered his Right to a speedy trial and years later he was still being maliciously persued. Sadly, he eventually copped out to a minor misdermeanor charge of possession.

Why do officers do this? it is the truth of their oath manifested. You see all officers share a sworn obligation to protect each others reputations which held far above anything else. This is their version of "integrity" actually its merely a criminal loyalty to each other regardless of the facts/truth. And don't be deceived, ALL defense attorneys are officers(double-agents), of the very same institution obligated by the same oath. Don't get me wrong, they'll sell-out for the right price (example OJ).

There is only one way to stop them from succeeding with their evil intentions; Demand enforcement by an agent of the Truth not the(ir) so-called "law". Which do you recognize as the greater and infact real Authority? Its your choice, choose wisely your decision may be more important than it seems.
