Because the ACLU is out to protect personal freedom - even for people (like these ultra-right wing psychopaths protesting at soldier's funerals) that hold views that most people find disgusting. The right to have a peaceful funeral is not in the constitution - the right to freedom of speech and the right to peacably assemble is in the constitution.
I really hope you'll see the logic behind what I'm saying here. The ACLU is not a partisan group - and the fact that most Republicans can't stand a group that supports freedom of speech for people of all political persuasions really makes no sense...

Because the ACLU is a heartless group with a hidden agenda. No, I am not against people protesting, but I think that a family has a right to mourn in peace and that common sense and good judgement should prevail. It's funny how the ACLU is all about free speech in this circumstance, but they fight the words, "illegal alien" or "Merry Christmas".

The family would have to bring suit. In my state (Michigan) these guys were protesting funerals, and it went to the supreme court who decided that they could protest up until an hour before the service, and immediately following the service. And from a certain distance away. They left town and we haven't seen them since! I think it is funny, though, that this family is made up of a bunch of lawyers, yet they still need the ACLU to take it up! Ridiculous

There are legal ways to protest a funeral. A family doesn't have the "right" to not allow anyone else to be at a cemetery during their service. They have the right not to be harassed, threatened, etc, but they don't have the right to stop people from legally protesting during the funeral service. The ALCU is only making sure those protesters are allowed to legally protest.
As sick as it is, there are legal ways to protest a soldiers funeral. It makes me sick to think that people would protest a soldiers funeral, but it also makes me sick to think about living in a country where the first amendment wasn't around.

The families do not have the constitutionally protected right to a peaceful funeral. One is protected one isn't.
As painful as that is to some people.
I do not understand why they are protesting the funerals or what they hope to gain, as it is christians and just makes them look nutty but it is their right.
