I would say the Toshiba because it has been around longer so will have better product support. The reviews of the gigabite are all solid too.
I don't know what the other commenter is talking about as far as it trying to make it's own file extensions, both use the standard mp3 format. I love subsciption services, it allows you to have a huge music library at your hands without paying for every single track you listen too. I subscribe to Napster and love it. I can listen to all the new albums, and play them until I'm sick of them without having to invest in the album and having tons and tons of CD's around that I no longer listen too.

If you ask me neither one. I'm not a big fan of subscription music services. Plus those both try and take over every mp3 file yo uhave and make you obtain their format.
