Just plain selfishness, denial, and addiction. It would be like drunk drivers saying they have the right to drink and drive.

Get over your self smokers should have the EXACT SAME rights as non smokers however that is not the case the smokers have been demonized and repressed by Feel Good legislation. Ask your self this If cigaretts are so bad why are they still legal? Ill tell you why TAX $ the state and local governments make WAY to much per pack to outlaw themYou have the right to leave if you feel you are at risk but you DO NOT have the right to impose your will fear or silly paranoia on someone for making a poor choice or being addicted to something that could kill them. Pity those week enough to get caught up in that don't hate them that would make you sound wicked ignorant don't you think.

I'm sort of in the gray area in this one. Can't stand smoke around me when I'm eating but it's private restaurant and I have the right to go there or not go there but now the government is telling the owner how to run the business. So what's next, ahhh yes no trans fat cooking...now some states are saying no smoking in cars that have children hmmm okay kids rights to breathe but again government intervention in our private lives. What really confuses me is that it seems the same groups of people that freak out about the government interfering in our privacy rights want them to do so only if it fits their nanny agenda but not of national security.

As a physician I am aware of the dangers of cigarette smoking but it is not illegal. Until we decide to make cigarette smoking illegal smokers have 'rights'. Cities and states have the right to restrict or ban smoking and many areas have done so. Employers have the same right and many work places are smoke free. I do not believe that anyone starts smoking with the intention to become addicted to cigarettes so we should be compassionate. In my experience it is easier for a person to quit drinking alcohol than to quit smoking. And as we have no truly effective intervention to help people stop smoking we must again be compassionate. If you do not wish to be exposed to cigarette smoke in public or private you should write to city, county, and state political elected officials and express your views. I find that it is possible to avoid cigarette smoking by chosing the places that I go. I would like to see cigarette smoking eventually eliminated but even anti smokers often regard such as notion as anti American. My father is a life long smoker whose lungs are now so damaged that he is not able to smoke even a single cigarette. Nonetheless he states that he will die a smoker. Thus I detest smoking and I would love to see all public places smoke free. I would hope that cigarettes eventually disappear from this country. Unfortuately I know that this is not likely to take place. Again my advice is to express your views to elected officials and to the places where you spend money but to remain compassionate to those who are addicted to nicotine.

I quit smoking when I was 11 but do not allow people to smoke in my house or car but it is not against the law. I do not want to see a law against it.
When I see young people smoke it makes me sad because of all the education that has been provided
We have too many laws and not enough common sense

In South Africa(where I am from), I rate about 70% of people smoke and we are not allowed to smoke in buildings. We are only allowed to smoke in open areas, in your own home and in your car and in some pubs. The South African government are quite strict about smoking. And as a smoker I must admit that it is unfair to smoke around non-smokers and yes, it is polluting their air. I hate smoking around non-smokers, I feel quilty and everyone else should too.

And just where the hell are you from, your own personal little smoke free island somewhere? And do you drive a car or ride a donkey? There are many forms of pollution and it certainly doesn't all originate in the US! You are either an idiot or bigot that uses the US as a scape-goat for any global problem. Take responsibility for the negligence and problem solving in your own backyard or STFU!

For the same reason non-smokers think it is their right to breathe the same air smokers do.
BOTH sides have rights, get used to it. BTW, I am a non-smoker who hates smoke if you care to know.

because everyone has rights and they're trying to protect their rights. If you've noticed, many states have made laws protecting not only restaurants, bars and clubs from smoking but also public buildings, parks and any other open space where children may be. check where you are locally to see what the laws are near you.

I don't smoke, and your and idiot. It's called freedom. I don't care if people smoke. My parents smoked around me as a matter of fact my mom smoked pregnant and we're all fine.
Kids have breathing problems because their parents are turning them into p*ssies. They don't go outside and get some germs on them daily. So shut the f*ck up and get over it douche bag.
