Anyone that rapes another person should never be let off, but; it is possible that because the witness doesn't want to pursue the incident any further the case COULD be dropped. Basically any rape case being brought to court has to pass two tests. This is how it stands in UK anyway.
Firstly they (crown prosecutors) must be satisfied that there’s enough evidence to provide a high chance of conviction. If a case fails to meet this first evidential test it won’t go to court.
The second test is where they must decide if a case, which has passed the first evidential test, is in the public interest and the CPS (crown prosecution service) considers rape to be so serious that a prosecution is required.

When a prosecution goes ahead the defendant's guilt has to be proved by the CPS. The police will look for forensic or medical evidence but it’s not an absolute must & a court case can still go ahead without it. The problem without having forensic or medical evidence is that If the jury can’t decide between what the victim and the defendant says (often there won't have been any witnesses to the rape) the case COULD be dropped

Once a complaint of this kind has been alleged it isn’t actually always that easy to just say a change of mind has occurred. If the rape was reported immediately & forensic/medical evidence along with statements had already been collected indicating that the accused had committed the crime, then the justice system can go ahead with the proceedings. If the victim/witness then changes his/her claim of rape to consensual sex nothing further can be done. (Providing there’s no medical evidence indicating otherwise) However, if the CPS believe or are aware that the victim/witness has been influenced in any way to change their plea then the case can continue & the victim/witness is obliged by law to give evidence as it would be seen as in the public interest to convict the perpetrator.
The victim/witness doesn’t have to face the defendant anymore in court cases such as these. It’s still possible for them to give their evidence by way of a TV link from another room somewhere else in the building without ever having to enter the court room or be in the presence of the defendant. Once the evidence has been given by the victim/witness they don’t have to stay to see the case out or return another day if they prefer not to.
The defendant would then not only be facing charges of rape but of trying to pervert justice as well.

It's very hard for a rapist be able to do such a thing. There are plenty of exams, like DNA, that can prove his act and the most important of all, the victim's testify. A witness is another element to prove a crime but not the only one, others elements like gynecological exams, testes, psychological distress, completed with the police investigation are also presented to the jury and judge. Fretting a witness is a very stupid way on trying to be let off because the police have experience to know right away what is going on and the rapist end up being charging for this crime too.

NO WAY !! Someone who rapes another person, male or female should not get away with it for any reason !! The witnesses should also be locked up for their stupidity. !! Rape is a major crime and no-one should ever get away with it under any circumstances. NEVER !!!!!

He should be castrated then thrown in jail with the most hardened criminals(pardon the pun), and A** raped for the rest of his life. He is scum! Actually, scum is too nice a word to describe him!

no he should be punished (although it wont be enough punishment if you ask me)...why should he get away with living his life care free when that poor woman will be scarred mentally if not physically and living in fear for the rest of her life...just because a man sees a woman and he is stronger bigger etc it does not give him the right to touch or invade her space.
