The service tax is same allover India.

The rate of service tax in most of the cases is 12.24% including cess.
In some cases like freight service tax effective rate is 25% of normal rate.Besides in some services exemption is there.
Further, small service providers having billing of taxab;e services upto Rs.4 lakh are exempt.

PUNE, January 14: The Pune-based Mahratta Chamber of Commerce and Industries (MCCI) has criticised the stand taken by the Mumbai-based Maharashtra Chamber of Commerce and Industries on the issue of service tax. At a meeting held in Nasik recently, the Maharashtra chamber had resolved that its members would not to get themselves registered or pay service tax. They also planned to go to the high court over the issue.
President of Mahratta chamber and chairman of the Sudarshan group RJ Rathi said that his chamber would not take a belligerent position on the issue.

However, agitated member-industrialists, both big and small, urged the Mahratta chamber to take a stronger stand on the matter as they were being harassed by inspectors and additional paper-work. Rathi agreed that the issue of service tax was a problematic one, but urged the members to pay under protest, assuring them that the issue would be taken up with the finance ministry.

The industry ire was directed mainly towards transporters who had passed the burden of service tax on to industry.

The transporters had used their muscle power and the government had yielded to their demands. Traders, too, had slipped through the service tax net. The industry grouse was that since they could not put up a united front on the issue, the government has conveniently passed on the burden of service tax on to them.

The government has also tightened rules pertaining to default of service tax payment. Earlier, goods could only be detained, but now the tax officers have been empowered to auction them.

Mahratta chamber adviser on excise LB Attar warned members that since non-registration and non-payment would lead to mounting liability and invite penalties, it was better to pay up and follow the rules. "Obtaining a stay will not help the industry avoid liability. So, going to court is a waste of time," he warned.

MG Sathe, a member, pointed out that initially 10% service tax was made out to be very simple and one had to only get a licence and file returns. But the industry has to get a separate licence for each services, which added heavily to their paper-work.

Members also complained that the service tax had added to their costs and excise duty was being paid over this tax, resulting in a cascading effect on the cost of their products.As the net for service tax widens, it will lead to more additions to the list and mean more work for the industry.

Thus, the members have demanded that a common licence be permitted for all kind of services.
