Not for this long. He did commit a crime and it isn't for Dr. Kevorkian to decide which crimes people should commit and which crimes people shouldn't commit. Society must decide for itself which actions to criminalize and it does that through the passage of laws through the legislature. Kevorkian tried to say that the law was unjust, but this wasn't a Jim Crow law we are talking about. This was a law regarding suicide. As such, he just went too far and got burned. However, I don't think 2nd Degree murder was the crime to charge him under. He assisted in a suicide and the "patient's" consent to it would, in my opinion, take away Kevorkian's malice necessary for a 2nd Degree murder conviction. But he did assist in a suicide which was illegal and he flouted the law many times. As such, he is guilty and should have been punished.

Unfortunately yes.

He would have done better to bring his patients who lived in states that didn't allow assisted suicide, into states that did, to do the deed.
