Depends on where the arena is situated. If they move into the current arena...I'm sorry, but the name of it escapes me...it is within the territorial areas of both the Leafs and Sabres.
However, if they were to build a new arena a little further south west...think I heard Ancaster or Dundas would be far enough, but don't quote me...they get outside either circle of influence and neither team would be able to demand fees from them.

That topic came up at this latest board of governors meeting, and basically, this question goes unanswered until someone in the league office does a viability study for a third franchise in the area. If I had to guess, they'll probably give both the Sabres AND Maple Leafs a little hush money.
Everyone concerned didn't seem to want to talk about this, with all parties saying they hope the Isle of Capri deal for a slot license goes through so the Penguins can stay in Pittsburgh. I think that the Penguins are as good as packed and moving.

Ultimately it would depend upon the NHL board of governors, the representatives of each club ( usually owners, presidents or general managers). In the past Hamilton has been discussed as a possible expansion or relocation city. Many of Buffalo's season ticket holders are from the Golden Horseshoe area. I'm sure the board of Governors would be reminded of that by the Buffalo Sabres. Not to mention the television market!

A move to violate would violate the territorial right of both the Buffalo Sabres and the Torronto Maple Leafs. Therefore, both teams would most likely be compensated if such a move were to occur.

Actually Mario has already been compensated. Although the sale may not have finished going through, he isn't going to be compensated because they move. He would be compensated for owning the team for a few years with his group.
