New year last year I had drank a lot... too much. I passed out on the floor next to a bunch of friends and the next morning I woke up and a guy I hadn't seen since high school was trying to undo my bra and had his hand down my pants. There was no digital penetration. But he was as close as you can come before that. Is this sexual assault? I just tried to laugh it off as him being extremely drunk still and it just being one of those things that happens.

This guy was not at my house when I passed out he came over long after I had passed out. Also this happened at my parents house with 10 of my close friends all passed out around me. I also woke up and told him to ge tthe he** off me. I told my firends about it the next day and they told me not to make it a big deal since nothing really happened. So I just kind of forgot about it until a discussion we had in one of my classes today.

My goodness! The answers you have gotten, lol. Ok, so, to answer your question, and remember, I don't know what state your talking about so I have to go with mine. It sounds more like sexual misconduct. Sexual assault occurs when the act involves force, violence or threat of intimidation. Sexual misconduct is non-consensual intentional physical conduct of a sexual nature. Since he basically invaded your privacy, and you are unharmed and not afraid of him in any way, I would seek the advice of a lawyer before filing charges. The legal cost alone would be staggering.

It's certainly not sexual assault, but it's borderline sexual harassment. It depends on the "victim's" response. If he/she says no repeatedly, it's definitely harassment. If she doesn't give a clear answer, probably not. Either way, the "attacker" is a loser. The person who did it is pretty much a loser too if he/she did it without wanting to. If the perpetrator uses violent coercion or blackmail to get the person to do it, then it can count as assault.

It is by law,yes..because you wasnt in right mind..but coming from a 23 year old getting drunk and passing out around someone like this isnt a good decision on YOUR PART for that reason,I hope this year you make a better choice

Its a good thing that we have schools. Ya know to remind us that certian things in the past need to be attended to. Common sense is forgotten but being drunk to the point that you pass out is unbelieveable. Yes I would think that that is assult. Check with your teacher- i mean a lawer.

I think I would have punched him, but are you positive that you weren't involved at all the night before?
I wish that you would have said something. Your friends never would have stood for it and his reputation would have been forever known to all. It could save someone else from experiencing the same thing.

Legally yes. Realistically - everyone was drunk and silly stuff happens, you were unhurt is the main thing. It is not good enough to just expect others to do the right thing by you, you have a responsibilty to look after yourself as well. Be more careful where you bed down in future.

Def. it is! For one you couldn't give consent because you were drunk and it was forced, if you still feel uncomfortable about it, report it. If you don't want to report tell him what he did was wrong!
Your body is your own! No one has the right to touch you if you don't want it!
